Terms of Service

1. Who we are

"Babil" refers to the social network available at this URL, operated by Murmures โ€” SCOP SARL, a French cooperative ("we", "us", "our"). Contact details are listed in the Imprint.

2. Acceptance of these terms

By creating an account or using Babil, you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the service. We may update these Terms from time to time; we will flag material changes and update the "Last updated" date above. Continued use after a change means you accept the updated Terms.

3. Eligibility

You must be at least 15 years old, or the minimum age required by your local law to consent to the processing of your personal data (whichever is higher). By registering, you confirm that the information you give us is accurate and that you are not barred from using the service under any applicable law.

4. Your account

  • You are responsible for keeping your password secure.
  • You are responsible for activity that happens under your account.
  • One person, one account. Automated, bot or impersonation accounts are not allowed unless we have given explicit written permission.
  • You can close your account at any time from the Settings page.

5. Content you post

You keep ownership of everything you post. By posting content on Babil, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute that content to the extent strictly necessary to operate the service (for example: showing your posts in other users' feeds, generating embeddings for the recommendation algorithm, creating backups).

This licence ends when you delete the content or your account, except for (a) copies retained in standard backups for a limited period, (b) content that others have already reshared or quoted, which we cannot retroactively remove from their accounts, and (c) copies retained as described in the retention and deletion sections of the Privacy Policy.

7. Acceptable use

You agree not to use Babil to:

  • Post unlawful content, or content that infringes the rights of others (including intellectual-property and privacy rights).
  • Harass, threaten or incite violence against other people.
  • Distribute malware, phishing links, or attempt to gain unauthorised access to any part of the service.
  • Scrape the service, abuse our APIs, or interfere with its normal operation.
  • Circumvent the daily interaction limits or other safety features that are part of Babil by design.

8. Moderation and enforcement

We may remove content, suspend or terminate accounts when we believe in good faith that the Terms or Community Guidelines have been broken, when we are required to do so by law, or when we need to protect the safety of users or the service. Where feasible we will let you know and give you a chance to appeal; for serious or legally mandated cases, we may act immediately.

9. The recommendation algorithm

Babil's differentiator is a transparent, user-controlled recommendation algorithm. We commit to:

  • Letting you inspect the signals the algorithm uses about you.
  • Letting you adjust weights and switch between named AlgoProfiles.
  • Letting you turn personalisation off and fall back to a chronological feed at any time.

Algorithmic transparency does not guarantee that the feed will be to your taste, nor that every piece of problematic content will be filtered out.

6. Federation and the Fediverse

Babil can federate with other servers on the Fediverse (the open network of services that speak the ActivityPub protocol). When your content is federated, it is copied to and stored on other independent servers that we do not own or control โ€” so a copy of that content does not live only on Babil. If you later delete the content or your account, Babil sends a deletion request to every server known to have received it, but we cannot force a remote server to comply: honouring deletions is up to each server's operator. This is an inherent property of every federated network, not a Babil-specific choice.

10. Disclaimers

Babil is provided "as is" and "as available". We make no warranty that the service will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, we disclaim all implied warranties.

11. Limitation of liability

To the fullest extent permitted by applicable law, Babil and its team are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of the service. Nothing in these Terms limits liability that cannot be limited under applicable law (including for gross negligence, wilful misconduct, or death and personal injury caused by negligence).

12. Changes to the service

Babil is actively developed. Features may appear, change or disappear without notice. We will not knowingly degrade the transparency features described above without giving users advance warning.

13. Termination

You may stop using the service at any time. We may terminate or suspend your access if you materially break these Terms. Sections that, by their nature, should survive termination (ownership, licence of retained content, disclaimers, limitation of liability, governing law) will do so.

14. Governing law and disputes

These Terms are governed by French law, without regard to its conflict-of-laws rules. Disputes that cannot be resolved informally will be brought before the competent courts of the place of our registered office (Grenoble, France), unless mandatory consumer-protection law in your country of residence gives you a different forum.
